The formula is as follows:
Issue (a short statement of the legal issue to guide the reader)
Rule (state the applicable rule needed to resolve the hypothetical; if a rule has several provisions, you need only use the applicable portions of a rule that assist
you in resolving the problem. You may paraphrase the rule, as long as the paraphrase is accurate)
Rule Explanation (this includes an explanation of how the rule is interpreted in the cases or other authorities we studied; describe the facts or holding of the case
to the extent relevant to your analysis)
Analysis/Application (discussion of each of the relevant facts and their legal significance, and consideration of any arguments and counter-arguments available when
applying the doctrine to the facts) and
Conclusion (resolving the application of the rule by stating the most favorable argument and the likely resolution of that element).
