USE THE UNIFORM COMMERCIAL CODES TO ANSWER THE FOLLOWING 14 QUESTIONS AND PROVIDE THE CODE FOR EACH ANSWER

  1. Collins runs a second-hand shop and offers to sell to Phillip a chest of drawers worth more than $2,500. Phillip agrees to buy the chest and signs a contract for the purchase. The price of the chest, however, is left out of the contract. Do Collins and Phillip have a contract? And if so, what will be the price of the chest?
  2. Adele decides to purchase several silver tea sets from Vaughn's gift store. In their sales contract, Adele and Vaughn do not specify how many silver tea sets Adele will purchase. Do Adele and Vaughn nonetheless have a contract? If so, how many tea sets must Adele buy?
  3. Oscar owns a jewelry store. Maura agrees to buy a watch for $3,150 that Oscar has ordered from Germany. Oscar and Maura fail to specify where delivery will take place. Under the UCC, where is the watch to be delivered or available for pickup?
  4. Gabby, who is planning to move, offers to sell her sofa to her friend Trent for $750. Trent says, "I'll take it, and I would like you to throw in the coffee table along with it." Under the UCC, do Gabby and Trent have a contract? And if so, for what?

  5. Bart orders 20,000 Class A widgets from Salvatore. Salvatore promptly ships to Bart 20,000 Class B widgets instead. Under the UCC, do Bart and Salvatore have a contract? And if so, has Salvatore breached the contract?
  6. Ronald telephones an order to Jason for seventeen custom-made doors that are uniquely designed for Ronald's unusual seaside mansion. Jason manufactures the custom doors and delivers them to Ronald, who refuses to pay on the basis that there is no written contract. Under the UCC, is there a valid oral contract?
  7. Rama returns home one evening to discover that his new $5,000 flat-screen television has been stolen. The thief then encounters Luke in an alley and sells him the television for $100. Luke does not know it was stolen. If Rama wants to recover his television, will Rama be able to recover it from Luke who wants to keep the television?
  8. Bart contracts with Stanley to purchase 10,000 boxes of widgets for delivery next month pursuant to a shipment contract. If an accident destroys the widgets while they are being shipped to Bart, does Stanley bear the risk of loss and the obligation to replace the destroyed goods?
  9. Kelly, a farmer, tells Farm Fresh Onions, Inc., that he will not be able to deliver the quantity of onions agreed to under the contract. If, before the time for performance has occurred, Farm Fresh Onions has not pursued an alternative source for onions and Kelly contacts Farm Fresh Onions to tell them that he can now perform, does Kelly have a right to perform under the contract?
  10. Holly comes into Matthew's bicycle shop to learn about the Easy Ride bicycle she saw in his newspaper ad. Matthew shows her the floor sample of the bicycle and says that it is designed to shift and brake more easily than her current model does. She decides to purchase one. Matthew gets a box from the back of the shop and sells it to her, stating that it contains the bicycle Holly wants. What kinds of express warranties, if any, has Matthew created about the Easy Ride bicycle that Holly purchased?
  11. Jackson goes to Jewelry Mart to buy an engagement ring for his significant other. The salesperson shows Jackson a beautiful diamond ring and states, "You won't find a diamond like this at this price anywhere." Jackson buys the ring and then discovers that a diamond of the same quality was for sale in a similar ring on the next block for $100 less than he paid. Will Jackson likely recover for a breach of warranty from Jewelry Mart?
  12. Joey sells a new clock from his store through an online auction website. He has never met the buyer, Rod, and had no communication with him before the auction. When he sends the clock, he does not disclaim any warranties. Does the sale of the clock have any warranties? If so, which one(s)?
  13. Carla is on vacation at a seaside resort, goes to a local Mexican restaurant and orders fresh grilled fish tacos. While eating one of the tacos, Carla cuts the inside of her mouth on a fishbone. Has there been a breach of any warranties by the local Mexican restaurant?
  14. If anyone brings suit against another person for breach of contract for the sale of goods, how long, under the UCC (Section 2-725) does she have to sue?
