2.Criminal Law U.K.
Read the following scenario.
Davina bore a grudge against Anne because Anne had stolen Davina’s boyfriend, Bill. One lunchtime, Davina went to her local pub. She saw Anne and Bill together at the bar. On seeing Davina, Anne shouted ‘He’s better off with me, you worthless witch.’ Davina was deeply offended. Four hours later, in order to frighten Anne into leaving Bill alone, Davina poured white spirit through the letterbox of Anne’s flat and set fire to it. The fire spread rapidly through Anne’s flat and also damaged neighbouring premises. Unfortunately, Anne was dozing in the flat at the time. She was overcome by smoke, which rendered her unconscious; and she suffered serious burns. Anne was taken to hospital where Dr George gave her a blood transfusion of the wrong type. She was put on life support but failed to regain consciousness and died. When she was arrested, Davina told the police that she had suffered a brain injury as a child, which, doctors say, causes her to react aggressively when under stress.
Answer the following questions:
1. Assess Davina’s liability for murder.
2. Discuss any defences she may have and what the likely outcome will be.
3. Assess Davina’s liability for any damage to the flat.
