Using the scenario below
Write an Analytic Application Essay of no less than 1,250 words answering the questions following the scenario below.
FACTS:  Road Runner Couriers (RRC) is a company with 25 employees located in the hypothetical state of Acme.  RRC provides services to businesses that require documents or packages to be delivered on a same day basis.  While most of these delivers are made by car or van, RRC also employs several bicycle couriers to accommodate customers in large cities.
Question 1:  After a rash of bicycle courier accidents in several cities, Congress passed a federal statute that banned bicycle couriers.  The statute is intended to protect the safety of the public at large.  Congress justifies the statute on the basis that couriers are inherently involved in commercial activity.
What enumerated power is Congress using as the basis of its authority to pass this statute?
Is the argument that Congress is using “commercial activity,” a valid argument?
If RRC challenges the constitutionality of the statute, what would be RRCs probably legal theory?
Question 2:  Suppose that instead of an outright ban on bicycle couriers, Congress passed a law that banned any companies that used bicycle couriers from receiving any money from federal grant programs or federal contacts.
How does this change impact your analysis related to congressional authority?
Question 3:  Assume that RRC also does business in the adjoining state of Toon Town.   Toon Town’s state legislature passes a state law that imposes a registration requirement on all couriers that are headquartered outside of Toon Town’s state borders.  The registration requirement also includes an annual fee that is not required of in-state couriers.  Has Toon Town infringed on Congress’s constitutional authority?
What is the standard used by courts to analyze the law in the question above?
