Fruits of the Poisonous Tree” Explain what the “fruits of the poisonous tree” mean.
In legal terms, the "Fruit of the Poisonous Tree" is a doctrine that extends the Exclusionary Rule. It stipulates that evidence obtained through unethical or illegal means (the "poisonous tree") is generally inadmissible in court, along with any subsequent evidence derived from that initial illegal action (the "fruit").
The logic is simple: if the source of the evidence is tainted by a constitutional violation, then anything that grows from that source is also tainted.
The Poisonous Tree: This is the primary illegality. For example, if police conduct a search of a home without a warrant and without "probable cause," they have violated the Fourth Amendment.
The Fruit: This is the evidence found during or because of that illegal search. If, during that warrantless search, the police find a key to a storage locker and subsequently find a weapon in that locker, both the key and the weapon are "fruit of the poisonous tree."
