EUROPEAN UNION LAW Order Description Word Limit: 1,500 Question ‘Since Dassonville, the case law on Article 34 TFEU has been driven by the desire of the Court of Justice to ensure that all non-fiscal measures that hinder the free movement of goods are prohibited. The court’s decision in Cassis de Dijon was a manifestation of this. However, as subsequent case law has demonstrated, the principles established in Dassonville and Cassis de Dijon have caused more legal problems than they have solved and the attempts by the court to resolve these problems have not worked. The only viable solution is now to abandon these principles entirely.’ Critically discuss this statement with reference to decided cases and academic opinion.
