Project Management Review the Scenario (unit 1 intro)and the addenda items detailed below. O Scenario As a newly assigned project manager for the Ohio Department of Human Services, you are excited about working with technology projects throughout the state. The Ohio Department of Human Services' (ODHS) Office of Network Support (ONS) is responsible for managing the network and software applications for over 15,000 state and county agency employees throughout Ohio's 88 counties. The office coordinates software upgrades and network modifications from an operations center located in the capital, Columbus, with assistance from local technology employees in each of the county seats. The position is not without its challenges, however. The network infrastructure throughout the state ranges from high quality, high-bandwidth connections in major population centers to older, partially working connections in the poorer, more regional counties. Additionally, budget and resources are a constant issue, with a high turnover rate among existing employees and an emphasis on outsourcing the labor force to several vendors to accomplish the myriad of support and project tasks. Your initial assignment is to examine the viability and costs associated with upgrading the existing e-mail, with the objective of developing the implementation project for the organization. ODHS had adopted the e-mail software called Globalupgrades (a Worldviewupgrades product) as its e-mail standard in 1994 and executed minor upgrades since then. However, the latest version of Globalupgrades, Version 9.0, contains significant enhancements desired by the ODHS user base, and the existing Version 7.0’s support will be phased out in the next year by Worldviewupgrades. The Worldviewupgrades sales representatives have been offering discounts for a Version 9.0 license, but the costs are approximately 20% more than previous licenses. Additionally, several other e-mail product vendors are lobbying state officials for business, some of them offering significant incentives. Generally, these products are viewed as less robust than Globalupgrades, but there are some segments of the user community that are supportive of these other options. You are reviewing the existing documentation on the current state of the e-mail system, including license agreements and the WorldviewupgradesGlobalupgrades 9.0 preliminary proposal. You are also examining the staffing structure and developing ideas on how to accomplish this task. In two weeks, you will need to brief the ONS Director on your planned approach to completing this effort. ODHS selected the Worldview Globalcom product for implementation in the E-mail Upgrade Project. The project was accomplished in 14,960 hours versus the planned 12,000 hours, at a total cost of 1.56M versus the planned 1.25M over a ten month (versus nine month planned) schedule. The Worldview vendor team had five key deliverables in the project, one of which was delivered 30 days late and another 10 days early. The Ohio Department of Corrections, as a result of watching this effort, is deploying the Globalcom product for their organization.Users report that they are very happy with the new e-mail system.Mahoning County’s infrastructure was too old to support the new emailsystem; they are being migrated next month as a separate project. The Worldview contract was completed within established cost. The Globalcom product’s spam filter requires a different network configuration than is currently in place for the network. The project team suffered from a 20% turnover rate during the life of this project, and exit interviews reveal salary was the overall cause. Develop a Lessons Learned document for the Worldview project with these specific action items: 1. Write three project success criteria that would have been included in the charter—you may use or reference the project objectives you wrote in Unit One. Explain your criteria. 2. Using the addenda items detailed above in addition to information you creatively develop, write your lessons learned based on the criteria and the three components of cost, schedule, and performance (you may use these as individual sections of your paper). Note, not all the addenda items may even be pertinent. 3. Answer the following in a summarizing, final page: Was the project a success? Why or why not? If not, were portions of the project a success, and what was the impact of those success areas on the overall determination of project success?

Legal and Ethical Considerations in Marketing, Product Safety, and Intellectual Property Order Description You are a new associate at the law firm of Dewey, Chetum, and Howe. John, a former researcher at PharmaCARE, comes to your office. He has concerns about PharmaCARE’s use of AD23, one of the company’s top-selling diabetes drugs. Two (2) years ago, after PharmaCARE’s research indicated that AD23 might also slow the progression of Alzheimer’s disease, John and his team of pharmacists began reformulating the drug to maximize that effect. In order to avoid the Food and Drug Administration’s (FDA) scrutiny, PharmaCARE established a wholly-owned subsidiary, CompCARE, to operate as a compounding pharmacy to sell the new formulation to individuals on a prescription basis. CompCARE established itself in a suburban office park near its parent’s headquarters. To conserve money and time, CompCARE did a quick, low-cost renovation. CompCARE benefited from PharmaCARE’s reputation, databases, networks, and sales and marketing expertise, and within six (6) months had the medical community buzzing about AD23. Demand soared, particularly among Medicare, Medicaid, and Veterans Affairs patients. Seeing the opportunity to realize even more profit, CompCARE began advertising AD23 directly to consumers and marketing the drug directly to hospitals, clinics, and physician offices, even though compounding pharmacies are not permitted to sell drugs in bulk for general use. To circumvent this technicality, CompCARE encouraged doctors to fax lists of fictitious patient names to CompCARE. PharmaCARE sold CompCARE to WellCo, a large drugstore chain, just weeks before AD23 was publicly linked to over 200 cardiac deaths. As CompCARE and its new parent company enjoyed record profits and PharmaCARE’s stock price approached $300 per share, reports started surfacing that people who received AD23 seemed to be suffering heart attacks at an alarming rate. The company ignored this data and continued filling large orders and paying huge bonuses to all the executives and managers, including John, whose wife recently died from a heart attack after using AD23. John has come to you with an internal company memo describing the potential problems with AD23, and information describing the company’s willingness “roll the dice” and continue to market the drug. Your senior partner has asked you to write a memo outlining the following issues for review by the senior partners. In preparation for this assignment, use the Internet to research examples of intellectual property theft that occurred within the past two (2) years. Research three to five (3-5) ethical issues relating to marketing and advertising, intellectual property, and regulation of product safety and examine whether PharmaCARE violated any of the issues in question. Argue for or against Direct-to-Consumer (DTC) marketing by drug companies. Provide support for your response. Determine the parties responsible for regulating compounding pharmacies under the current regulatory scheme, the actions that either these parties or the FDA could / should have taken in this scenario, and whether PharmaCARE could face legal exposure surrounding its practices. Support your response. Analyze the manner in which PharmaCARE used U.S. law to protect its own intellectual property and if John has any claim to being the true “inventor” of AD23. Suggest at least three (3) ways the company could compensate John for the use of his intellectual property. Summarize at least one (1) current example (within the past two [2] years) of intellectual property theft, and examine the effect on that company’s brand. Analyze the potential issue surrounding the death of John’s wife and other potential litigants against PharmaCARE as a result of AD23. Specify both the major arguments that John can make to claim that he is a whistleblower and the type of protections that he should be afforded. Justify your response. Use at least three (3) quality resources in this assignment. Note: Wikipedia is not an acceptable reference and proprietary Websites do not qualify as academic resources. Your assignment must follow these formatting requirements: Be typed, double spaced, using Times New Roman font (size 12), with one-inch margins on all sides; citations and references must follow APA or school-specific format. Check with your professor for any additional instructions.
