Q: Alter McGrath’s biggest client, Occidental Petroleum Corporation, has a major problem on their hands. Occidental was sued in the United States District Court for the Central District of California by indigenous Peruvians. Our litigation team did a great hop getting the case dismissed to Peru on the grounds of Forum non convenient. We believe that the Peruvians sued in the United States in order to get a bigger payout. However, the indigenous Peruvian appealed to the United States Court of Appeals for the Ninth Circuit. The Ninth Circuit reversed the district court and held that the case should be heard in California.
SO we must Write an Appellate brief on the issue of Whether the Ninth Circuit erred in finding the trial court abused its discretion when it dismissed the case to Peru on the ground of Forum Non Conveniens?
