ARGUMENT DECONSTRUCTION – MARKING RUBRIK
As genetic science advances, more discoveries are being made to uncover the gene mutations that predict a higher probability of disease and other health problems. Private organizations invest in research to develop tests to discover the genes and their mutations. To recoup their initial investment and to make a future profit, these research organizations have been success patenting some naturally occurring human genes. Meaning that any test that uses the information from the gene is the property of the organization.

The Childrens Hospital of Eastern Ontario has launched a lawsuit, claiming that genes are parts of nature not items that were designed by mankind. Since parts of nature are not eligible for patent protection, the patents that have been granted are illegitimate.

Supporters say that as discoverers of the gene, the organization should be able to earn a fair profit in order to encourage other organizations to develop research.

On the other hand, having even a small portion of your body owned by another individual or group denies the nature of our individual-ness.

Taking a position and defending it is the essence of a good argument. In this assignment you are asked to support or oppose this idea:

It is in the best interest of society that all research has a financial reward, therefore patents on human genes are an acceptable incentive to motivate the type of medical research that benefits us all.

Create a short (3-4 paragraph) argument in favour of this idea or opposed to this idea. On a separate page you will dissect your argument and diagram it according to the conventions in the text and lectures.

No marks will be awarded for arguing for or against this proposition. Marks will be awarded for the composition of your argument and for your demonstrated understanding of the structure of your argument. The marking rubric is offered below.
